‘ICJ can’t stop hanging of culprits in Nirbhaya case’

New Delhi, 18/3: Former Supreme Court Judge BN Srikrishna said on Tuesday (March 17) that the International Court of Justice cannot stop the hanging of the convicts on March 20 in the Nirbhaya case. Three of the four convicts in the Nirbhaya gang rape and murder case have approached the Hague-based International Court of Justice (ICJ) requesting them to stop their “unlawful” execution. They allege they were convicted through a “flawed investigation”.

In response to the pleas of the convicts, Justice Shri Krishna said that the ICJ can do something only in those cases which fall under its jurisdiction. He said, “I don’t think the ICJ can stop the execution by interfering in this case.” He also said that the ICJ is not the next court of appeal. The former judge said, “God’s court is the last appellate court for him (the convicts).” Human Rights Commissions can also interfere only when there is no natural justice.

He said, “Due to due process, in this case, the trial was first held in the lower court, then the High Court and its Supreme Court. Apart from this, all the convicts also filed a number of reconsideration petitions and curative petitions in the apex court. He said that the international judicial body cannot decide on cases on which the Indian judiciary has already decided through the hearing and appeals processes.
